Truck Accident Explosion Caused by Drunk Driver Claims the Life of Texas Man

On March 28, 2011, Alejandro Raya, a fuel delivery truck driver for Petro-Chemical Transport, was fatally killed by a wrong-way drunk driver on I-30, near Fort Worth, Texas, around 2:30 a.m.

Louis Nieves, 23, the driver of the pick-up truck that crashed into the tanker, killing the 45-year-old father of three, was arrested on suspicion of driving under the influence and was taken to the Mansfield Jail. Nieves admitted to police officers that he drank 10 beers, prior to getting on the road, and was immediately charged with intoxication manslaughter.

The head-on collision caused the tanker truck to overturn and explode into flames. Trapped inside the cab compartment of the truck, Alejandro Raya died at the scene of the accident. Severe damages to the bridge over Sycamore Creek required emergency repairs to be made. The intensity of the heat caused the steel beams inside the bridge to melt, as crews from the Texas Department of Transportation frantically worked to clean up the fuel spill.

Amelia Raya, who was married to Alejandro Raya for 19 years, expressed her grief to reporters in an NBC Dallas-Fort Worth news interview. She mentions the truck accident has “destroyed her family” and that her husband was “a good father, a hard worker—very responsible.”

The Raya family continues to grieve their loss as they try to move on with their life.

Dallas Man Miraculously Survives Motorcycle Crash

On March 17, 2011, Texas motorcycle rider, Zacharie Perez, was thrown off his motorbike, smashing in between two cars, after being rear ended on a Dallas tollway. The accident was caught on surveillance tape and shows Perez rolling around on the freeway, as cars swerve and begin to slow down to avoid hitting him. Zacharie Perez, an army veteran, miraculously survives and was able to share his story in an exclusive interview on Good Morning America.

Now being hailed as the “Motorcycle Miracle Man”, Mr. Perez explains how he was heading home and was approximately 5 to 10 minutes away, when he was driving northbound on the Dallas tollway. On passing the car that would eventually rear end him, Zacharie Perez began to slow down with the traffic as he noticed the car in front of him had put on their breaks. The silver car directly behind Mr. Perez can be seen driving at full speed when it hits the motorcycle.

Mr. Perez, who was wearing his helmet, was immediately rushed to Parkland Memorial Hospital. He suffered major injuries involving a ruptured spleen, internal bleeding, a broken rib, road rash, and four broken vertebrae. Doctors were not able to determine at that time if he would need surgery to treat a hernia, but Mr. Perez has expressed that if he hadn’t been wearing a helmet, he probably would have been dead.

Texas motorcycle drivers are not required to wear a helmet.

According to ABC News reports, the driver that hit Mr. Perez had no insurance and was driving without a license. Mr. Perez was upset that the driver was not arrested.

Widower Files Wrongful Death against Toyota after Gas Pedal Sticks

On February 2, 2010, Houston NBC Affiliate KPRC reported that a wrongful death lawsuit against Toyota was filed by Michael Harris of Houston after his wife was killed, when the gas pedal on her 2009 Toyota Corolla caused “uncontrollable” acceleration. Mr. Harris blames the world’s largest Japanese automaker for Trina Harris’s death and is asking for $200 million in damages.

The car crash happened one week before Christmas in 2009, as Trina was driving in the northeast Houston area. The accelerator got stuck as she was driving, causing her to crash into a concrete wall and killing her immediately. Mr. Harris and his lawyer allege that Trina’s 2009 Toyota Corolla contained a defect in its accelerator pedal and are calling Trina’s Toyota a “death trap”. The lawsuit also claims that Toyota knew of its risky gas pedal months before the January 2010 recall of 2 million Toyotas.

With the help from his lawyer, Michael Harris continues to fight on behalf of his wife, Trina Harris, who is also survived by her two teenage daughters.

Dog Bite Injuries in Texas Raise Concerns Among U.S. Postal Service Mail Carriers

Last year in 2010, the United States Postal Service reported the cities that had the most dog bite attacks producing personal injuries nationwide. At the top of the list, Houston led the way with 62 mail carriers being attacked by dogs. This is only a small number compared to the 5,669 postal service employees, who were attacked delivering the mail in more than 1,400 cities.

Annually, 4.7 million Americans are bitten by dogs, and the majority of those dog bite injuries happen to children. Aside from costly medical expenses to alleviate the pain and suffering caused by dog bite injuries, the Insurance Information Institute reported nearly $413 million dollars of homeowner’s insurance liability claims was paid out in 2010.

Dog bites are serious injuries that should not be ignored. If you or someone in your family has been attacked by a dog, your first step should be to consult an experienced Austin personal injury attorney, who can help you to obtain the compensation you deserve.  Texas homeowners have a responsibility to keep their property safe. This includes controlling their pets and preventing personal injuries to innocent bystanders and postal workers.

Since Texas is a “one-bite rule” state, victims of dog bite injuries must be able to prove that the dog has a history of violence and that the owner was aware of it. Dog owners living in a one-bite rule state may not be held liable the first time their dog attacks someone. That is why it is highly important you speak to an Austin, Texas, personal injury attorney immediately, if you have been injured or bitten by a dog. An experienced lawyer can help you seek the compensation you deserve.

Texas Texting Driving Ban Awaiting Approval

Texas Texting Driving Ban Awaiting Approval

One of the main causes of car wrecks is distracted driving, and mobile devices are a major factor in these accidents. Automobile accidents like these are completely avoidable, but continue to happen across the county.

The state of Texas ban on texting while driving was approved by the Senate and the House late on May 29, 2011. The bill includes $200 fines for those caught in the act. If signed by Governor Perry, the bill would be enacted on September 1, 2011.

Texting while driving is distracting and dangerous. There are two current Texas laws against texting while driving. One prohibits minors to use cellular devices while driving, and the other bans cell phone use while driving in school zones. These steps forward in texting legislation have made the roads safer for all Texans, especially children.

According to the University of Utah, driving while using a cell phone (hands on or hands free) delays a person’s reaction time as much a legally drunk drivers (.08 Blood Alcohol Content). Also, drivers that use mobile devices are four times more likely to get into serious car crashes (Insurance Institute for Highway Safety).

If you or a loved one has been injured or killed in a texting while driving car accident in the central Texas area, please contact or call 512-474-2001. The Texas auto accident attorneys at Gonzales & Gonzales will schedule a confidential, no-cost consultation with you today!

Unrealistic Schedules for Truck Drivers

Our fast-paced lifestyle takes its toll on every aspect of society. One consequence of this pace is entirely avoidable, and that is truck accidents that result from unrealistic schedules for truck drivers.

Competition Leads to Tight Schedules

Competition for shipping contracts often motivates trucking companies to offer faster deliveries when lower rates aren’t enough to win the bid.

Competition for “loads” motivates truck drivers to deliver loads as quickly as possible so they get more work.

All of this sets the stage for unrealistic schedules for truck drivers, and that increases the risk that you or I might be injured in an avoidable truck accident.

High-Pressure Job

Truck driving is a high-pressure job. Many drivers say they’re ready to rest after seven or eight hours of driving. Driving up to eleven hours at a time is more than many can handle.

Because it is legal, employers will expect their drivers to give the maximum amount of service in the interests of the company and require drivers to keep moving for 11 hours. While the Hours of Service Regulations also require a ten-hour rest period to follow, many drivers can’t get enough sleep and all their personal needs taken care of in that time.

In addition, drivers are not paid for overseeing loading and unloading, equipment checks, repairs and other required activities, and time spent on those activities is deducted from the driver’s rest period. It all adds up to an increased risk to other drivers and pedestrians.

If you have been injured or incurred expenses or damages as a result of a truck accident, please contact Gonzales & Gonzales personal injury attorneys in Austin, who know how to get the compensation you deserve.

Wrong Way Auto Accidents| Texas Injury Attorney

There are technical differences between head-on collision accidents and wrong way car accidents. Head-on collisions include any accident where two vehicles collide head-on. Wrong way accidents are specific to auto accidents occurring on one-way roadways.

When you bring us your wrong way accident case, we consider a number of factors that caused or contributed to your accident. Certain personal as well as highway design factors have, historically, played a role in different driver’s decisions to go the wrong way. Some of these differentiate wrong way accidents from other head-on collisions.

For example, on a two-lane road with only a yellow line separating two directions of traffic, a head-on collision can be caused by a driver drifting over the line. In a wrong way accident, there are barriers to prevent “drifting” into oncoming traffic.

Some barriers are only signage, as with one-way streets. Others are grassy areas, concrete barricades, rows of construction cones or barrels, railings and other physical barriers between the two directions of traffic. Construction zone accidents are often sites of wrong-way accidents.

Accident investigations involve an in-depth study and analysis of roadway as well as personal contributing factors. Our reputation for successful settlements is due in great part to our experienced and proven investigators whose data have justified our claims.

If you or a loved one has been injured or killed in a wrong way car accident in the Austin area, please contact the Texas auto accident attorneys at Gonzales & Gonzales today to schedule a confidential, no-cost consultation.

Auto Accidents in Construction Zones

Across the country, new construction zones are set up to maintain highway safety as a “cure” to the cause of dangerous roadways. Although deteriorating or inadequate roads cannot be ignored, statistics on accidents in construction zones testify to how dangerous the cure is.

Few of us can avoid these maze-like detours. Many drivers become impatient when construction delays them with waits up to thirty minutes. Impatient or fatigued truck drivers may become aggressive. Patrol officers are the only known deterrent to speeders in construction zones. But law enforcement budgets just can’t afford to post an officer at each construction site. So, infractions that compromise safety continue.

On the construction side, there are many errors and negligent acts that construction workers do regularly. A thorough investigation of a construction zone accident can reveal multiple infractions that compromised safety, causing or worsening the accident.

When an experienced and competent law team investigates construction zone accidents they are able to uncover the parties liable for your injuries and losses, and pursue an appropriate settlement for you.

When you need the benefit of our no-cost evaluation of your construction zone accident case, please contact Austin’s construction zone accident attorneys at Gonzales & Gonzales, serving clients in the Austin and Round Rock, Texas areas.
