10-Year-Old Girl Hit by Car at School Bus Stop Survives
Posted: January 25, 2012In Travis County, Texas, a little girl was hit by a car while trying to catch her school bus early Tuesday morning. According to KXAN.com, Rithy Kehm, the driver of the Green Honda that hit Molly Finley at the Rocky Creek Subdivision off Hamilton Pool Road, failed to stop and passed the school bus, causing the accident.
Finley was taken to Dell Children’s Hospital where she was treated for a scraped chin, bruises on her knees and scrapes on her feet. With no major personal injuries, she was released wearing an arm sling.
Apparently, the Bee Cave Elementary fifth grader forgot her backpack and went back to get it out of her momâs car. As the bus driver waited, Rithy Kehm drove around and accidently hit the 10-year-old.
Molly Finley could hardly see the car that hit her.
“Well, my mom yelled and I looked on the side and saw it but it was too late,” said Finley.
The driver of the Honda was ticketed for passing the school bus and not displaying an ID. People who witnessed the accident say Kehm was âvisibly shakenâ.
The bus stop at the community’s front entrance has frequently caused backups, and residents say drivers would frequently pass the busses. After the incident on Tuesday the HOA posted signs informing the community, that beginning Wednesday, the stop will move from the community’s mailboxes to the community’s amenities center, away from the front entrance.
Molly knows how lucky she is to have survived the accident without too many personal injuries.

Posted: November 17, 2011Based on reports by the Bureau of Transportation Statistics, the Sunday after Thanksgiving is the busiest travel day of the year, with an estimated 13.7 million long-distance trips taken. Although people have the option to travel by plane, train or bus, nearly 91% of all long-distance holiday travel is by car. With more people on the road, drivers in Austin, Texas, need to be careful.
The chances for getting into a car accident during the busiest time of the year dramatically increases, as families head out in droves to gather together. Keep your family safe this year and every holiday season, by following 5 important safety tips from auto accident attorneys.
1. Check Your Vehicle Before Taking a Road TripâHeading out on the road can be dangerous, especially if your car isnât functioning properly. Always inspect your vehicle before taking it on a long-distance road trip.
2. Avoid Texting and Talking on the Cell Phone While DrivingâEvery state has different cell phone usage laws while driving. If youâre traveling outside the state of Texas, you can avoid driver distractions by not using your cell phone when driving.
3. Donât Fall Asleep at the WheelâIf youâre tired after driving for long hours, itâs better to find the nearest rest stop or well-lit area off the side of the road to take a nap. Halloween Safety Tips You Can Follow While Trick-or-Treating in Austin
Posted: October 19, 2011Itâs already time for Halloween to sneak up on us and before we even say âBooâ, kids will be running through the neighborhood dressed in their decorative costumes, knocking on the front door, and asking for candy. As exciting and fun as Halloween can be, there are a few safety tips that parents and motorists can follow to avoid getting âspookedâ by unexpected personal injury accidents and to ensure that you and your child will have a safe and happy Halloween.
ï Drivers Need to See You: It can be hard for motorists to see little children walking around at night, especially if they are wearing dark costumes while crossing the street. Parents and children need to be seen by a car; that means carrying flashlights wearing bright colors, reflectors, or investing in glow sticks, to make sure cars can see you.
ï Make Sure Your Costume is Safe to Wear: Costumes with masks make it difficult to see out of your peripheral vision and can increase the risk of pedestrian accidents. Even if your costume does not involve a disguise, you should not wear costumes that would camouflage you with the environment (such as all black when trick-or-treating at night) or long garments that would cause you to slip and fall.
ï Pick a Well-Lit Neighborhood with Sidewalks: Areas that tend to have a lot of traffic and not enough street lighting or sidewalks can be especially dangerous. Consider driving to a neighborhood with plenty of lighting and space to go trick-or-treating.
ï Never Go Trick-or-Treating Alone: Travel in groups when you go door-to-door.
ï Follow Basic Traffic Safety Tips: Always look both ways before crossing the street. Use the crosswalk at all times and be sure you make eye contact with drivers. You may be able to see them, but you want to be sure they stop and see you.
If you or your child has suffered from a personal injury from trick-or-treating on Halloween or at any time during the year, contact an Austin personal injury accident attorney today.

Labor Day Weekend Brings Police Out in Full Force to Crackdown on Drunk Drivers in Austin, Texas
Posted: September 2, 2011Labor Day Weekend is the time for celebration and relaxation; itâs also a time when the number of alcohol related car accidents occur. As people leave town to enjoy the last days of summer with their friends and family, Austin police will be on the lookout for anyone suspected of DWI.
The National Highway Traffic Safety Administration reports that 11,000 people die every year as a result of drunk driving. This number increases around the holidays, as more people tend to be out on the road. In Texas alone, there were 3,071 fatalities caused by DWI, in 2009.
In an effort to bring national awareness to stop drunk driving, the NHTSA has released major ad campaigns with the saying, âDrive Sober or Get Pulled Overâ to encourage people to get involved and to spread the word about the dangers of driving while intoxicated.
It is estimated that someone dies every 23 minutes, between the early hours of midnight and 3AM, due to alcohol-impaired traffic related accidents. According to DMV.Org, if you are pulled over and arrested on DUI/DWI charges in Texas, not only could you be facing large penalties and fines of up to $2,000 as a first offense, but you could also cause serious injuries or worse, go to prison for manslaughter, if you kill someone in a drunk driving related car crash.
This is no way to spend your Labor Day Weekend.

Back-to-School Child Safety Driving Tips for Parents in Austin, Texas
Posted: September 1, 2011Itâs that time of year again for summer to end, fall to set in, and for the school year to begin. While many parents are excited for their little ones to go back to school, itâs important to exercise a few traffic safety tips to help keep your child safe and to avoid personal injuries.
According to the National Highway Traffic Safety Administration (NHTSA), motor vehicle accidents were the number one cause of death for children ages 3 to 14, in 2006.
Even with ever changing car technology and advancements, parents should never underestimate the dangers of leaving their child inside or near a vehicle, without proper adult supervision. Children are quick to act on impulse and could easily start a carâs engine, shift the gears in neutral, and cause a fatal car crash resulting in serious injuries.
What are the seating requirements to help prevent children from being injured in cars?
It is recommended that any child, under the age of 13, should ride in the back seat of the car. Depending on the age, height, and weight of your child, the appropriate child seat restraints must be selected accordingly. For example, a newborn would need to ride in an infant-only, rear-facing car seat. Toddlers, ages 1-3, would also need to ride in a rear facing car seat based on your car seat manufactureâs height and weight limit. A child age 4 to 7, however, may need a forward-facing car seat with a harness, till they outgrow that, and move on to a booster seat.
What if I donât drive my child to school?
If your child will be walking or riding a bike to school, not only should they understand traffic laws and obey traffic signs and signals, but teaching your child to make eye contact with drivers, before crossing the street, can safeguard against your child being hit by an inattentive driver.
Parents need to think about more than just buying school books and school supplies for their childâs first day back. Itâs important to always take the necessary precautions to ensure your child travels safely, to and from school, all year-round.

The accident was caught on surveillance tape and shows Perez rolling around on the freeway, as cars swerve and begin to slow down to avoid hitting him. Zacharie Perez, an army veteran, miraculously survives and was able to share his story in an exclusive interview on Good Morning America.
Now being hailed as the âMotorcycle Miracle Manâ, Mr. Perez explains how he was heading home and was approximately 5 to 10 minutes away, when he was driving northbound on the Dallas tollway. On passing the car that would eventually rear end him, Zacharie Perez began to slow down with the traffic as he noticed the car in front of him had put on their breaks. He suffered major injuries involving a ruptured spleen, internal bleeding, a broken rib, road rash, and four broken vertebrae. Widower Files Wrongful Death against Toyota after Gas Pedal Sticks
Posted: July 8, 2011On February 2, 2010, Houston NBC Affiliate KPRC reported that a wrongful death lawsuit against Toyota was filed by Michael Harris of Houston after his wife was killed, when the gas pedal on her 2009 Toyota Corolla caused âuncontrollableâ acceleration. Mr. Harris blames the worldâs largest Japanese automaker for Trina Harrisâs death and is asking for $200 million in damages.
The car crash happened one week before Christmas in 2009, as Trina was driving in the northeast Houston area. The accelerator got stuck as she was driving, causing her to crash into a concrete wall and killing her immediately. Mr. Harris and his lawyer allege that Trinaâs 2009 Toyota Corolla contained a defect in its accelerator pedal and are calling Trinaâs Toyota a âdeath trapâ. The lawsuit also claims that Toyota knew of its risky gas pedal months before the January 2010 recall of 2 million Toyotas.
With the help from his lawyer, Michael Harris continues to fight on behalf of his wife, Trina Harris, who is also survived by her two teenage daughters.

Unrealistic Schedules for Truck Drivers
Posted: September 7, 2010Our fast-paced lifestyle takes its toll on every aspect of society. One consequence of this pace is entirely avoidable, and that is truck accidents that result from unrealistic schedules for truck drivers.
Competition Leads to Tight Schedules
Competition for shipping contracts often motivates trucking companies to offer faster deliveries when lower rates arenât enough to win the bid.
Competition for âloadsâ motivates truck drivers to deliver loads as quickly as possible so they get more work.
All of this sets the stage for unrealistic schedules for truck drivers, and that increases the risk that you or I might be injured in an avoidable truck accident.
High-Pressure Job
Truck driving is a high-pressure job. Many drivers say theyâre ready to rest after seven or eight hours of driving. Driving up to eleven hours at a time is more than many can handle.
Because it is legal, employers will expect their drivers to give the maximum amount of service in the interests of the company and require drivers to keep moving for 11 hours. While the Hours of Service Regulations also require a ten-hour rest period to follow, many drivers canât get enough sleep and all their personal needs taken care of in that time.
In addition, drivers are not paid for overseeing loading and unloading, equipment checks, repairs and other required activities, and time spent on those activities is deducted from the driverâs rest period. It all adds up to an increased risk to other drivers and pedestrians.
If you have been injured or incurred expenses or damages as a result of a truck accident, please contact Gonzales & Gonzales personal injury attorneys in Austin, who know how to get the compensation you deserve.

Wrong Way Auto Accidents| Texas Injury Attorney
Posted: July 20, 2010There are technical differences between head-on collision accidents and wrong way car accidents. Head-on collisions include any accident where two vehicles collide head-on. Wrong way accidents are specific to auto accidents occurring on one-way roadways.
When you bring us your wrong way accident case, we consider a number of factors that caused or contributed to your accident. Certain personal as well as highway design factors have, historically, played a role in different driverâs decisions to go the wrong way. Some of these differentiate wrong way accidents from other head-on collisions.
For example, on a two-lane road with only a yellow line separating two directions of traffic, a head-on collision can be caused by a driver drifting over the line. In a wrong way accident, there are barriers to prevent âdriftingâ into oncoming traffic.
Some barriers are only signage, as with one-way streets. Others are grassy areas, concrete barricades, rows of construction cones or barrels, railings and other physical barriers between the two directions of traffic. Construction zone accidents are often sites of wrong-way accidents.
Accident investigations involve an in-depth study and analysis of roadway as well as personal contributing factors. Our reputation for successful settlements is due in great part to our experienced and proven investigators whose data have justified our claims.
If you or a loved one has been injured or killed in a wrong way car accident in the Austin area, please contact the Texas auto accident attorneys at Gonzales & Gonzales today to schedule a confidential, no-cost consultation.

Auto Accidents in Construction Zones
Posted: June 1, 2010Across the country, new construction zones are set up to maintain highway safety as a âcureâ to the cause of dangerous roadways. Although deteriorating or inadequate roads cannot be ignored, statistics on accidents in construction zones testify to how dangerous the cure is.
Few of us can avoid these maze-like detours. Many drivers become impatient when construction delays them with waits up to thirty minutes. Impatient or fatigued truck drivers may become aggressive. Patrol officers are the only known deterrent to speeders in construction zones. But law enforcement budgets just canât afford to post an officer at each construction site. So, infractions that compromise safety continue.
On the construction side, there are many errors and negligent acts that construction workers do regularly. A thorough investigation of a construction zone accident can reveal multiple infractions that compromised safety, causing or worsening the accident.
When an experienced and competent law team investigates construction zone accidents they are able to uncover the parties liable for your injuries and losses, and pursue an appropriate settlement for you.
When you need the benefit of our no-cost evaluation of your construction zone accident case, please contact Austinâs construction zone accident attorneys at Gonzales & Gonzales, serving clients in the Austin and Round Rock, Texas areas.
