Halloween Safety Tips You Can Follow While Trick-or-Treating in Austin

It’s already time for Halloween to sneak up on us and before we even say “Booâ€, kids will be running through the neighborhood dressed in their decorative costumes, knocking on the front door, and asking for candy. As exciting and fun as Halloween can be, there are a few safety tips that parents and motorists can follow to avoid getting “spooked†by unexpected personal injury accidents and to ensure that you and your child will have a safe and happy Halloween.

 Drivers Need to See You: It can be hard for motorists to see little children walking around at night, especially if they are wearing dark costumes while crossing the street. Parents and children need to be seen by a car; that means carrying flashlights wearing bright colors, reflectors, or investing in glow sticks, to make sure cars can see you.
 Make Sure Your Costume is Safe to Wear: Costumes with masks make it difficult to see out of your peripheral vision and can increase the risk of pedestrian accidents. Even if your costume does not involve a disguise, you should not wear costumes that would camouflage you with the environment (such as all black when trick-or-treating at night) or long garments that would cause you to slip and fall.
 Pick a Well-Lit Neighborhood with Sidewalks: Areas that tend to have a lot of traffic and not enough street lighting or sidewalks can be especially dangerous. Consider driving to a neighborhood with plenty of lighting and space to go trick-or-treating.
 Never Go Trick-or-Treating Alone: Travel in groups when you go door-to-door.
 Follow Basic Traffic Safety Tips: Always look both ways before crossing the street. Use the crosswalk at all times and be sure you make eye contact with drivers. You may be able to see them, but you want to be sure they stop and see you.

If you or your child has suffered from a personal injury from trick-or-treating on Halloween or at any time during the year, contact an Austin personal injury accident attorney today.

Texas GDL Laws Help Austin Teens Drive Smart and Stay Safe on the Road

States like Texas have adopted a Graduated Driver’s License (GDL) program, to help keep young drivers safe and to decrease the number of fatalities associated with teen-related car crashes.

According to the Centers for Disease Control and Prevention and data taken from the NHSTA, (National Highway Traffic Safety Administration), 2009 reports estimated about 3,000 teens in the United States were killed in motor vehicle accidents. That same year, more than 350,000 teen drivers were treated for personal injuries in the emergency room.

Even though teenagers drive less than many older adults, they are the most at-risk group for getting into car wrecks. Studies have shown that motor vehicle accidents are the leading cause of death for teenagers and young adults (ages 15-20), in the United States.

Some factors that cause teenagers to be more prone to car accidents are attributed to:
• Lack of driving experience
• Not being able to recognize hazardous road conditions
• Not wearing a seat belt
• Underage drinking leading to DUI-related car accidents
• Other teenagers in the car
• Talking on the cell phone or texting while driving
• Trying to multitask and other driver distractions

As outlined on Texas dmv.org, soon-to-be teen drivers, under the age of 18, can slowly transition into obtaining a driver’s license, by completing the basic requirements in Phase One and Phase Two, of the Graduated Driver’s License Program:

• Phase 1: Teen drivers younger than 18 must take the classroom portion of driver’s education; be at least 15 to obtain and hold a learner’s permit for 6 months; finish the laboratory (driving) portion of driver’s education; be at least 16 to apply for a Class C license or 17 to apply for a Class A or B license.

• Phase 2: Once a 16 or 17 year-old obtains a license, they must maintain a valid provisional license for another 6 months, before they can get a regular driver’s license without restrictions.

States adopting the Graduated Driver License (GDL) program saw a 20% decline in motor vehicle crashes involving teenagers.

Labor Day Weekend Brings Police Out in Full Force to Crackdown on Drunk Drivers in Austin, Texas

Labor Day Weekend is the time for celebration and relaxation; it’s also a time when the number of alcohol related car accidents occur. As people leave town to enjoy the last days of summer with their friends and family, Austin police will be on the lookout for anyone suspected of DWI.

The National Highway Traffic Safety Administration reports that 11,000 people die every year as a result of drunk driving. This number increases around the holidays, as more people tend to be out on the road. In Texas alone, there were 3,071 fatalities caused by DWI, in 2009.

In an effort to bring national awareness to stop drunk driving, the NHTSA has released major ad campaigns with the saying, “Drive Sober or Get Pulled Over†to encourage people to get involved and to spread the word about the dangers of driving while intoxicated.

It is estimated that someone dies every 23 minutes, between the early hours of midnight and 3AM, due to alcohol-impaired traffic related accidents. According to DMV.Org, if you are pulled over and arrested on DUI/DWI charges in Texas, not only could you be facing large penalties and fines of up to $2,000 as a first offense, but you could also cause serious injuries or worse, go to prison for manslaughter, if you kill someone in a drunk driving related car crash.

This is no way to spend your Labor Day Weekend.

Back-to-School Child Safety Driving Tips for Parents in Austin, Texas

It’s that time of year again for summer to end, fall to set in, and for the school year to begin. While many parents are excited for their little ones to go back to school, it’s important to exercise a few traffic safety tips to help keep your child safe and to avoid personal injuries.

According to the National Highway Traffic Safety Administration (NHTSA), motor vehicle accidents were the number one cause of death for children ages 3 to 14, in 2006.

Even with ever changing car technology and advancements, parents should never underestimate the dangers of leaving their child inside or near a vehicle, without proper adult supervision. Children are quick to act on impulse and could easily start a car’s engine, shift the gears in neutral, and cause a fatal car crash resulting in serious injuries.

What are the seating requirements to help prevent children from being injured in cars?

It is recommended that any child, under the age of 13, should ride in the back seat of the car. Depending on the age, height, and weight of your child, the appropriate child seat restraints must be selected accordingly. For example, a newborn would need to ride in an infant-only, rear-facing car seat. Toddlers, ages 1-3, would also need to ride in a rear facing car seat based on your car seat manufacture’s height and weight limit. A child age 4 to 7, however, may need a forward-facing car seat with a harness, till they outgrow that, and move on to a booster seat.

What if I don’t drive my child to school?

If your child will be walking or riding a bike to school, not only should they understand traffic laws and obey traffic signs and signals, but teaching your child to make eye contact with drivers, before crossing the street, can safeguard against your child being hit by an inattentive driver.

Parents need to think about more than just buying school books and school supplies for their child’s first day back. It’s important to always take the necessary precautions to ensure your child travels safely, to and from school, all year-round.

Truck Accident Explosion Caused by Drunk Driver Claims the Life of Texas Man

On March 28, 2011, Alejandro Raya, a fuel delivery truck driver for Petro-Chemical Transport, was fatally killed by a wrong-way drunk driver on I-30, near Fort Worth, Texas, around 2:30 a.m.

Louis Nieves, 23, the driver of the pick-up truck that crashed into the tanker, killing the 45-year-old father of three, was arrested on suspicion of driving under the influence and was taken to the Mansfield Jail. Nieves admitted to police officers that he drank 10 beers, prior to getting on the road, and was immediately charged with intoxication manslaughter.

The head-on collision caused the tanker truck to overturn and explode into flames. Trapped inside the cab compartment of the truck, Alejandro Raya died at the scene of the accident. Severe damages to the bridge over Sycamore Creek required emergency repairs to be made. The intensity of the heat caused the steel beams inside the bridge to melt, as crews from the Texas Department of Transportation frantically worked to clean up the fuel spill.

Amelia Raya, who was married to Alejandro Raya for 19 years, expressed her grief to reporters in an NBC Dallas-Fort Worth news interview. She mentions the truck accident has “destroyed her family†and that her husband was “a good father, a hard worker—very responsible.â€

The Raya family continues to grieve their loss as they try to move on with their life.

Dallas Man Miraculously Survives Motorcycle Crash

On March 17, 2011, Texas motorcycle rider, Zacharie Perez, was thrown off his motorbike, smashing in between two cars, after being rear ended on a Dallas tollway. The accident was caught on surveillance tape and shows Perez rolling around on the freeway, as cars swerve and begin to slow down to avoid hitting him. Zacharie Perez, an army veteran, miraculously survives and was able to share his story in an exclusive interview on Good Morning America.

Now being hailed as the “Motorcycle Miracle Manâ€, Mr. Perez explains how he was heading home and was approximately 5 to 10 minutes away, when he was driving northbound on the Dallas tollway. On passing the car that would eventually rear end him, Zacharie Perez began to slow down with the traffic as he noticed the car in front of him had put on their breaks. The silver car directly behind Mr. Perez can be seen driving at full speed when it hits the motorcycle.

Mr. Perez, who was wearing his helmet, was immediately rushed to Parkland Memorial Hospital. He suffered major injuries involving a ruptured spleen, internal bleeding, a broken rib, road rash, and four broken vertebrae. Doctors were not able to determine at that time if he would need surgery to treat a hernia, but Mr. Perez has expressed that if he hadn’t been wearing a helmet, he probably would have been dead.

Texas motorcycle drivers are not required to wear a helmet.

According to ABC News reports, the driver that hit Mr. Perez had no insurance and was driving without a license. Mr. Perez was upset that the driver was not arrested.

Widower Files Wrongful Death against Toyota after Gas Pedal Sticks

On February 2, 2010, Houston NBC Affiliate KPRC reported that a wrongful death lawsuit against Toyota was filed by Michael Harris of Houston after his wife was killed, when the gas pedal on her 2009 Toyota Corolla caused “uncontrollable†acceleration. Mr. Harris blames the world’s largest Japanese automaker for Trina Harris’s death and is asking for $200 million in damages.

The car crash happened one week before Christmas in 2009, as Trina was driving in the northeast Houston area. The accelerator got stuck as she was driving, causing her to crash into a concrete wall and killing her immediately. Mr. Harris and his lawyer allege that Trina’s 2009 Toyota Corolla contained a defect in its accelerator pedal and are calling Trina’s Toyota a “death trapâ€. The lawsuit also claims that Toyota knew of its risky gas pedal months before the January 2010 recall of 2 million Toyotas.

With the help from his lawyer, Michael Harris continues to fight on behalf of his wife, Trina Harris, who is also survived by her two teenage daughters.

Dog Bite Injuries in Texas Raise Concerns Among U.S. Postal Service Mail Carriers

Last year in 2010, the United States Postal Service reported the cities that had the most dog bite attacks producing personal injuries nationwide. At the top of the list, Houston led the way with 62 mail carriers being attacked by dogs. This is only a small number compared to the 5,669 postal service employees, who were attacked delivering the mail in more than 1,400 cities.

Annually, 4.7 million Americans are bitten by dogs, and the majority of those dog bite injuries happen to children. Aside from costly medical expenses to alleviate the pain and suffering caused by dog bite injuries, the Insurance Information Institute reported nearly $413 million dollars of homeowner’s insurance liability claims was paid out in 2010.

Dog bites are serious injuries that should not be ignored. If you or someone in your family has been attacked by a dog, your first step should be to consult an experienced Austin personal injury attorney, who can help you to obtain the compensation you deserve.  Texas homeowners have a responsibility to keep their property safe. This includes controlling their pets and preventing personal injuries to innocent bystanders and postal workers.

Dog owners living in a one-bite rule state may not be held liable the first time their dog attacks someone. That is why it is highly important you speak to an Austin, Texas, personal injury attorney immediately, if you have been injured or bitten by a dog. Texas Texting Driving Ban Awaiting Approval

Texas Texting Driving Ban Awaiting Approval

One of the main causes of car wrecks is distracted driving, and mobile devices are a major factor in these accidents. Automobile accidents like these are completely avoidable, but continue to happen across the county.

The state of Texas ban on texting while driving was approved by the Senate and the House late on May 29, 2011. The bill includes $200 fines for those caught in the act. If signed by Governor Perry, the bill would be enacted on September 1, 2011.

Texting while driving is distracting and dangerous. There are two current Texas laws against texting while driving. One prohibits minors to use cellular devices while driving, and the other bans cell phone use while driving in school zones. These steps forward in texting legislation have made the roads safer for all Texans, especially children.

According to the University of Utah, driving while using a cell phone (hands on or hands free) delays a person’s reaction time as much a legally drunk drivers (.08 Blood Alcohol Content). Also, drivers that use mobile devices are four times more likely to get into serious car crashes (Insurance Institute for Highway Safety).

If you or a loved one has been injured or killed in a texting while driving car accident in the central Texas area, please contact or call 512-474-2001. The Texas auto accident attorneys at Gonzales & Gonzales will schedule a confidential, no-cost consultation with you today!
