10-Year-Old Girl Hit by Car at School Bus Stop Survives
Posted: January 25, 2012In Travis County, Texas, a little girl was hit by a car while trying to catch her school bus early Tuesday morning. According to KXAN.com, Rithy Kehm, the driver of the Green Honda that hit Molly Finley at the Rocky Creek Subdivision off Hamilton Pool Road, failed to stop and passed the school bus, causing the accident.
Finley was taken to Dell Children’s Hospital where she was treated for a scraped chin, bruises on her knees and scrapes on her feet. With no major personal injuries, she was released wearing an arm sling.
Apparently, the Bee Cave Elementary fifth grader forgot her backpack and went back to get it out of her momâs car. As the bus driver waited, Rithy Kehm drove around and accidently hit the 10-year-old.
Molly Finley could hardly see the car that hit her.
“Well, my mom yelled and I looked on the side and saw it but it was too late,” said Finley.
The driver of the Honda was ticketed for passing the school bus and not displaying an ID. People who witnessed the accident say Kehm was âvisibly shakenâ.
The bus stop at the community’s front entrance has frequently caused backups, and residents say drivers would frequently pass the busses. After the incident on Tuesday the HOA posted signs informing the community, that beginning Wednesday, the stop will move from the community’s mailboxes to the community’s amenities center, away from the front entrance.
Molly knows how lucky she is to have survived the accident without too many personal injuries.

Austin Police Department Enforces DWI Initiative for New Yearâs Eve
Posted: December 30, 2011Every New Yearâs Eve weekend, the Austin Police Department announces the âNo Refusalâ DWI initiative from 9p.m-5a.m., from December 30th to December 31st. Since New Yearâs Eve is one of the busiest nights of the year for many people in Austin, Texasânot to mention around the world â it is also one of the most tragic nights of the year where more people end up in the hospital as a result of personal injuries, brought on by DWI-related motor vehicle accidents.
The purpose of the DWI initiative is to enforce DWI laws, so that people can stay safe on the roads as they travel on this night. Each year a high number of DWI arrests are made in Austin, Texas. Traffic fatalities increase during the holidays, and New Yearâs Eve sees more people out on the street, drinking and driving till they end up in a hospital, than on any other night.
With the âNew Yearâs Eve No Refusalâ initiative program, the Austin Police Department hopes to educate people about the dangers of drinking and driving while intoxicated. If a person doesnât have the money to pay for a taxi, or is too alcohol impaired to drive their car, there are other options to getting home safe. Choosing a designated driver for the night is the best way to begin planning your New Yearâs Eve celebration. You also have the option to use SoberRide, which is a free cab ride service that can take you to your destination.

This Year, Austin Personal Injury Attorneys Want You to Decorate Your Holiday with âBalls of Hollyâ, Not Balls of Fire
Posted: December 21, 2011In preparation for this holiday season, millions of people across Texas and nationwide will be hanging Christmas tree lights and burning their candles bright. With all the hustle and bustle that goes into picking the right tree and dazzling it with ornaments, itâs easy to forget the dangers involved when lighting up the house.
According to the U.S. Consumer Product Safety Commission (CPSC) on About.com, candles start about 11,600 fires annually, âresulting in 150 deaths, 1200 injuries, and $173 million in property lossâ.
So before you start climbing up the roof to string your decorations from one end to the next, you may need to follow a few safety tips provided by CPSC, to keep your holiday free from personal injury.
Pay Attention to the Type of Tree You Purchase
⢠If you are going to purchase an artificial tree this Christmas, make sure it is labeled âFire Resistantâ. Trees that are fire resistant can still catch fire, but the advantage is that they tend to extinguish a lot quicker.
⢠If you want to purchase a naturally grown, âliveâ tree for authenticity, it should be fresh. Youâll know when a tree is fresh because it will be green with needles that wonât break when you bend it. The needles will also be hard to pull from the branches.
⢠When setting up your tree at home, be sure to keep it away from fireplaces and radiators. Depending on the type of tree you get, fresh trees should be watered to prevent drying out. All trees should be set up where they wonât block room entrances.
Decorations and Lighting
⢠Non-combustible, flame-resistant materials should be used to trim a tree.
⢠Never place lit candles on a tree. If lighting candles around the house, itâs best to use non-flammable candle holders.
⢠Any lights you hang outside or inside the house should have fused plugs and conform to safety standards.
⢠Electric lights on a metallic tree should NEVER be used. Repeat NEVER. Faulty lights can cause the tree to be charged with electricity and if anyone touches the tree or even a branch on the tree, could be electrocuted.
⢠Finally, when you go to bed at night, make sure you turn off all the lights; literally, turn off all the lights including holiday lights and those candles burning bright.

1. Check Your Vehicle Before Taking a Road TripâHeading out on the road can be dangerous, especially if your car isnât functioning properly. Always inspect your vehicle before taking it on a long-distance road trip.
2. Avoid Texting and Talking on the Cell Phone While DrivingâEvery state has different cell phone usage laws while driving. If youâre traveling outside the state of Texas, you can avoid driver distractions by not using your cell phone when driving.
3. Donât Fall Asleep at the WheelâIf youâre tired after driving for long hours, itâs better to find the nearest rest stop or well-lit area off the side of the road to take a nap. Falling asleep behind the wheel can not only cause a major car crash, but it can also cause personal injuries to you and others.
4. Donât Drink and DriveâDWI is one of the leading causes of car crashes in Texas and the surrounding areas. Find a designated driver to take you home, if you plan on drinking at a holiday party.

Avoid Burn Injuries When Deep-Frying Your Turkey This Thanksgiving
Posted: November 16, 2011Deep-frying turkey on Thanksgiving Day has become increasingly popular in many households. Unfortunately, more grease fires occur on this holiday, than on any other day of the year.
According to State Farm Insurance, Texas ranked #1 for having the most cooking related fire accidents on Thanksgiving Day, from 2005-2009. Since turkey frying has become a delicious alternative to traditional baked turkey on Thanksgiving, U.S. fire departments across the nation, are putting out an average of more than 1,000 fires each year, involving deep fryers.
There are ways, however, to prevent grease fires and possible burn injuries, if you do decide to deep-fry your turkey this holiday season. Here are some important safety tips to keep in mind:
⢠Be Careful Not to Use Too Much Oil in the Fryer Potâbeing splattered with hot oil is considerably one of the worst types of burn injuries that can occur, since frying oil has a tendency to stick to the skin. If you donât measure the correct amount of oil to use, it could overflow, hit the burner, and cause a fire. Be sure to follow the ownerâs manual.
⢠Be Sure Your Turkey is Completely Thawed and Dryâpartially frozen or wet turkey that is dipped into temperatures of 350 degrees or more, can cause an instant grease fire. Make sure your turkey is dry, inside and out, before lowering it into the deep fryer.
⢠Donât Deep-Fry Turkey on Woodâif youâre going to deep-fry your turkey this year, make sure you cook it outside, away from the house, and NOT on wooden surfaces.
⢠Keep a Fire Extinguisher Nearbyâyou never know when a grease fire will erupt, so itâs best to have a fire extinguisher approved for cooking or grease fire close by, and call 911 for help immediately.
⢠Never Leave the Fryer Unattendedâdeep fryers donât have thermostat controls, which means the oil will continue to heat up to the point of combustion.

Halloween Safety Tips You Can Follow While Trick-or-Treating in Austin
Posted: October 19, 2011Itâs already time for Halloween to sneak up on us and before we even say âBooâ, kids will be running through the neighborhood dressed in their decorative costumes, knocking on the front door, and asking for candy. As exciting and fun as Halloween can be, there are a few safety tips that parents and motorists can follow to avoid getting âspookedâ by unexpected personal injury accidents and to ensure that you and your child will have a safe and happy Halloween.
ď Drivers Need to See You: It can be hard for motorists to see little children walking around at night, especially if they are wearing dark costumes while crossing the street. Parents and children need to be seen by a car; that means carrying flashlights wearing bright colors, reflectors, or investing in glow sticks, to make sure cars can see you.
ď Make Sure Your Costume is Safe to Wear: Costumes with masks make it difficult to see out of your peripheral vision and can increase the risk of pedestrian accidents. Even if your costume does not involve a disguise, you should not wear costumes that would camouflage you with the environment (such as all black when trick-or-treating at night) or long garments that would cause you to slip and fall.
ď Pick a Well-Lit Neighborhood with Sidewalks: Areas that tend to have a lot of traffic and not enough street lighting or sidewalks can be especially dangerous. Consider driving to a neighborhood with plenty of lighting and space to go trick-or-treating.
ď Never Go Trick-or-Treating Alone: Travel in groups when you go door-to-door.
ď Follow Basic Traffic Safety Tips: Always look both ways before crossing the street. Use the crosswalk at all times and be sure you make eye contact with drivers. You may be able to see them, but you want to be sure they stop and see you.
If you or your child has suffered from a personal injury from trick-or-treating on Halloween or at any time during the year, contact an Austin personal injury accident attorney today.

Texas GDL Laws Help Austin Teens Drive Smart and Stay Safe on the Road
Posted: October 2, 2011States like Texas have adopted a Graduated Driverâs License (GDL) program, to help keep young drivers safe and to decrease the number of fatalities associated with teen-related car crashes.
According to the Centers for Disease Control and Prevention and data taken from the NHSTA, (National Highway Traffic Safety Administration), 2009 reports estimated about 3,000 teens in the United States were killed in motor vehicle accidents. That same year, more than 350,000 teen drivers were treated for personal injuries in the emergency room.
Even though teenagers drive less than many older adults, they are the most at-risk group for getting into car wrecks. Studies have shown that motor vehicle accidents are the leading cause of death for teenagers and young adults (ages 15-20), in the United States.
Some factors that cause teenagers to be more prone to car accidents are attributed to:
⢠Lack of driving experience
⢠Not being able to recognize hazardous road conditions
⢠Not wearing a seat belt
⢠Underage drinking leading to DUI-related car accidents
⢠Other teenagers in the car
⢠Talking on the cell phone or texting while driving
⢠Trying to multitask and other driver distractions
As outlined on Texas dmv.org, soon-to-be teen drivers, under the age of 18, can slowly transition into obtaining a driverâs license, by completing the basic requirements in Phase One and Phase Two, of the Graduated Driverâs License Program:
⢠Phase 1: Teen drivers younger than 18 must take the classroom portion of driverâs education; be at least 15 to obtain and hold a learnerâs permit for 6 months; finish the laboratory (driving) portion of driverâs education; be at least 16 to apply for a Class C license or 17 to apply for a Class A or B license.
⢠Phase 2: Once a 16 or 17 year-old obtains a license, they must maintain a valid provisional license for another 6 months, before they can get a regular driverâs license without restrictions.
States adopting the Graduated Driver License (GDL) program saw a 20% decline in motor vehicle crashes involving teenagers.

Posted: September 2, 2011Labor Day Weekend is the time for celebration and relaxation; itâs also a time when the number of alcohol related car accidents occur. As people leave town to enjoy the last days of summer with their friends and family, Austin police will be on the lookout for anyone suspected of DWI.
The National Highway Traffic Safety Administration reports that 11,000 people die every year as a result of drunk driving. This number increases around the holidays, as more people tend to be out on the road. In Texas alone, there were 3,071 fatalities caused by DWI, in 2009.
In an effort to bring national awareness to stop drunk driving, the NHTSA has released major ad campaigns with the saying, âDrive Sober or Get Pulled Overâ to encourage people to get involved and to spread the word about the dangers of driving while intoxicated.
It is estimated that someone dies every 23 minutes, between the early hours of midnight and 3AM, due to alcohol-impaired traffic related accidents. According to DMV.Org, if you are pulled over and arrested on DUI/DWI charges in Texas, not only could you be facing large penalties and fines of up to $2,000 as a first offense, but you could also cause serious injuries or worse, go to prison for manslaughter, if you kill someone in a drunk driving related car crash.

Back-to-School Child Safety Driving Tips for Parents in Austin, Texas
Posted: September 1, 2011Itâs that time of year again for summer to end, fall to set in, and for the school year to begin. While many parents are excited for their little ones to go back to school, itâs important to exercise a few traffic safety tips to help keep your child safe and to avoid personal injuries.
According to the National Highway Traffic Safety Administration (NHTSA), motor vehicle accidents were the number one cause of death for children ages 3 to 14, in 2006.
Even with ever changing car technology and advancements, parents should never underestimate the dangers of leaving their child inside or near a vehicle, without proper adult supervision. Children are quick to act on impulse and could easily start a carâs engine, shift the gears in neutral, and cause a fatal car crash resulting in serious injuries.
What are the seating requirements to help prevent children from being injured in cars?
It is recommended that any child, under the age of 13, should ride in the back seat of the car. Depending on the age, height, and weight of your child, the appropriate child seat restraints must be selected accordingly. For example, a newborn would need to ride in an infant-only, rear-facing car seat. Toddlers, ages 1-3, would also need to ride in a rear facing car seat based on your car seat manufactureâs height and weight limit. A child age 4 to 7, however, may need a forward-facing car seat with a harness, till they outgrow that, and move on to a booster seat.
What if I donât drive my child to school?
If your child will be walking or riding a bike to school, not only should they understand traffic laws and obey traffic signs and signals, but teaching your child to make eye contact with drivers, before crossing the street, can safeguard against your child being hit by an inattentive driver.
Parents need to think about more than just buying school books and school supplies for their childâs first day back. Itâs important to always take the necessary precautions to ensure your child travels safely, to and from school, all year-round.
